Asked in Traffic Tickets for Colorado

Q: I received traffic citation from Alamosa County,CO..in 2004. I failed to appear..now have warrant. I live in Illinois.

I want to resolve situation..asap. I WAS told to send email to Deputy Clerk asking Judge,etc. For trial by phone. I AM UNSURE WHAT to say OR HOW to do this?HELP.

A: First, you may want to talk to a lawyer in Alamosa who can handle paperwork in Colorado and give advice along the process.

If you want to not use a lawyer, you will first need to contact the applicable police department about settling the warrant. Before you call the contact the courts, you need to know more about your case and the scope of the warrant. In the extreme you may need to return to Colorado to serve time etc.

If you do go to trial (which may not occur), you may be able to have a phone appearance. This can be handled by filing a motion in to the case requesting appearance by phone. These are usually granted in civil cases, but may not be granted in a criminal case.
