A: Since it sounds like the insurance company is not your health insurance company, you will need to send the bills (or copies) to the driver's insurance company. This is because the driver's insurance company does not have access to your medical records. You are not required to send the bills to the insurance company if you are planning on suing, but if you are trying to reach an out-of-court settlement, you will likely need to send the bills.

A: Understand what matters is the injury; the fact that you feel they were rude, uncaring etc isn't compensable. If being a jerk were grounds for suit I'd need to hire 10 more attorneys just for this area! Seriously, why not contact a member of the Colorado Assn for Justice--they give free consults. Note also, the medical bills may be paid by the vehicle's medpay, so if you have unpaid bills consider discussing that aspect with the attorney.
