West Newton, PA asked in Car Accidents for Kentucky

Q: Can I sue uninsured motorist who hit my car and left?

My car was hit while parked outside of my work and the guy left. He was later caught by the police and I didn't know anything had happened until I found the police note on my car. The police filed a report and impounded his vehicle, but the guy doesn't have insurance. I know my insurance will cover cost of repair, but I'll still have to pay a deductible. Is there any way I can sue this guy for my deductible missed work to get the car repaired? And would it even be worth it? He is a West Virginia resident and I am Kentucky.

A: Talk to your insurance.Chances are they will sue him and you want them to include your deductible claim. Watch what you do if you agree to accept the deductible from the uninsured guy as you don't want to affect the insurance company's right to go after that person--if you do they'll be looking at you!
