If you have collision coverage and you are over the deductible, you may have a claim with your insurance company.
A: The words are getting in the way. "No fault" is a term of art. There is no such thing in Illinois. Apparently, you were in an accident where you were not at fault. As such, you are entitled to sue for damages but that would be foolish. If the defendant did not have insurance, simply report the accident and the loss to the Secretary of State. They will suspend the defendant's license until he pays. They will forward the money to you.
