Tempe, AZ asked in Contracts, Divorce, Family Law and Civil Rights for Arizona

Q: I'm being forced to sale my home, for way less than I agree.

My wife and I have been going through a divorce for more than a year now. She moved out a year ago, I stayed in our marital home. Its on her credit not mine and she got the judge to order the sale of the home and her attorney proposed an agent by the name of Tim. He is on the list of cert. court real estate agents so whatever I'm fine with that. Well I dont know how much power he has. He gave my ex and I two weeks to agree on a listing price and we couldnt. He came up with 6 comps but 2 of the comps he used are Shortsales! So its skewing the value. He is saying its worth $285, I want it listed for $340 my ex says $320k. The home appraised 2 years ago for $330 we are in a nice neighborhood. Zip code 85298 and zillow has the home value at $377k. So yesterday Tim was like I'm taking pics tomorrow and listing the home for $299. What the heck?! I feel like I'm living in a communist country, my own home being sold for a price I dont agree with. There's no decree. HELP!

A: If the final order does not address listing price by giving you the power to veto the listing price, or a minimum list price, then you may not have any say over the listing.
