Newark, NJ asked in Traffic Tickets for New Jersey

Q: Is it worth going to trial with an officer who lied about a ticket regarding my passenger but then he gives me 1 in nj?

I just entered the highway and was in the middle lane. There was no keep right signs that I saw and 4 state troopers were behind me. To my left were a ton of cars to my right was a mack truck and in front of me were other cars. Further along the highway I'm still in the middle lane doing the speed limit while my fiance is sleeping with his seat belt on. We finally get pulled over and my fiance asks why we were pulled over. He says because I was in the middle lane. The officer still isn't talking to me at this point only to my fiance. My fiance states he didn't know that was illegal and the officer proceeds to say it's been a law for a few years now. He says he'll let me off with a warning but when he asked for both of our information my fiance didn't feel the need to give it to him because he wasnt driving. The officer got mad and overall my passenger was compliant but ended up being arrested and he got a ticket for not wearing a seat belt that he did have on and I got 1 too

A: It will be expensive and hard to prove, unless the Police Officer was wearing a body camera or his car camera was on and it is really good quality and you can see into the car. Not sure what he gave you tickets for, so hard to say if it is worth fighting at trial, negotiating with the Prosecutor, or just paying.

A: Although it would be expensive to fight it in regards to time, I suggest that you at least try if your are innocent. Not worth hiring a lawyer for a seatbelt ticket but still worth fighting.
