Pinellas Park, FL asked in Real Estate Law for Florida

Q: Can I hold the sellers realtor responsible to reimburse expenses to buy a home that went to auction?

The contract was signed by both parties, appraisal, inspection and the down payment were all paid for. The seller delayed closing and the property was foreclosed on and sold at auction 2 days before our second closing date.

A: Based upon the facts you list. I would say maybe. It would depend upon a number of factors. I suggest that you may want to consult with an attorney in your area and discuss the specifics of this case to see if it is worth you filing a lawsuit or claim against the realtor.

A: I will assume the seller's tried to delay the sale by foreclosure. That being the case, what control did the seller's realtor have to delay the sale by foreclosure. In addition - since you did not employ the seller's realtor what duty did the seller's realtor have to you?

I don't think you have a claim.
