San Francisco, CA asked in Real Estate Law and Landlord - Tenant for California

Q: Breaking our lease by 1 month. We must pay the remaining month. Can we choose not to vacate despite giving 30 day notice

We gave 30 day notice in May to leave in early June. Our lease ends in early July. They found a replacement when our lease ends. Because they are charging us the entire month of June, must we vacate because we gave notice? Or can we stay since we are paying until essentially the end of our lease?

A: If you have a lease you have the right to stay until the lease end. If you choose to do that, you will want to notify the landlord immediately that you have decided to stay until lease end. If the landlord wants you to more early, then you can demand that you be relieved of the last month's rent.
