Q: If I back out as a buyer, after contingencies, apart from losing earnest money could the seller actually sue?

The appraisal came back higher than contract price so they could even raise the price and put it back on the market. Also no one has sent me an actual number from the appraisal or a copy of it yet

A: If you breach the contract, then yes, seller could sue you. If they sell for more than the purchase price, they might still have other damages for any delay or expenses in re-selling it. But if they sue, they would tie up the property in litigation, and would be unable to sell it until the lawsuit was resolved. Use the Find a Lawyer tab to consult a local real estate attorney.
