Q: If a ticket is re-issued, and contains differences compared to the original, can i fight the ticket?
I recieved a Road Spill and No Medical Certificate ticket at the beginning of May, the city cops never got the paperwork sorted out and the court date on the ticket was never set up. The cops just reissued the ticket to me today, and even though it was signed by the same cop, it was given to me by a different cop, and there is a change in the time it happened by 2 minutes, and the ticket changed from being in violation of state law to being in violation of local ordinance. Are either of these valid reasons to fight the ticket?
A: No. Violation is a violation whether state or city law. The law under which the ticket is issued determines what governmental entity receives the share of the fine and costs. The 2 minutes makes no difference whatsoever.
