Q: My ex husband father to my son skipped town 3 years ago and only texted once a year a single text

Also he has failed to pay his child support in over a year now and only paid for 3 months before that he is in the rears for 40k can I terminate his rights so my current husband of 6 years can adopt my son

A: Yes, it is possible. Wilfully failing to pat Child Support for 12 consecutive months is a ground for termination of his rights. This must be done in an action separate from an adoption.
