New York, NY asked in Animal / Dog Law for California

Q: A friend gave her dog to a fellow who is not taking good care of him. Can she get the dog back and how?

This fellow crates the dog, goes out for the whole evening frequently and this dog now about 4 has never been crated before. The dog has a sensitive stomach and he will not feed the dog his recommended food and seems mystified when the dog throws up. He took away the dog's favorite toy on grounds that he thought the dog might choke on it. The owner is sick and doesn't think she can ask for the dog back.

A: She can ask, but the dog belongs to the new owner. It's his property and will remain his until he sells or gives it away, or it is seized from him due to animal cruelty.
