Alameda, CA asked in Animal / Dog Law and Real Estate Law for California

Q: My neighbors dog keeps jumping the fence into our backyard. What can we do to stop this? The owner is aware too.

Our dog is starting to get aggressive with us when we get between her and the other dog to get the dog out of our yard. The neighbors dog is a male and ours female but she's been fixed. I don't want my dog to bite one of us because of the other dog and this dog jumps the fence into our yard constantly, we constantly have to go let the neighbor know her dog is in our backyard and they have to come get it or the neighbor has come here to my house letting us know their dog is in the yard. I don't want to take the chance that the dog will jump the fence when my kids are in the yard with our dog. We can not afford to put up a taller fence to keep the neighbors dog out, plus the fence was replaced before we bought the house in 2015. I've been nice up to this point until my own dog started getting aggressive and the neighbors dog seems nice but also will not let us get between it and our dog. What can be done?

A: Advise the neighbor that you will call Animal Control when the dog is in your backyard. Ask them to put a fence extender up.
