Q: A business was built next to my home. It was built to where anyone can see over my fence.
I have no privacy in my back yard where I used to lay in the sun nude. The business built a sidewalk beside my privacy fence and it takes no effort to just look over it.
I have no idea if photos or video is being taken. The business does, however, have security cameras that may include my back yard.
Is this legal?
A: You don't have a right to sunbathe in the nude that trumps the right of a property owner to build on their land whatever the zoning code allows. For instance if they want a two story or more building and it's OK by zoning, they could do that.
