Orlando, FL asked in Civil Litigation and Car Accidents for Florida

Q: Insurance carrier said if I am going to claim from my insurance the future premiums are going to raise

So looking forward to claim from defaulters insurance if the damages total up to his liability ,Since he hit my stopped car due to his negligence. I do not wish to pay for his mistakes and could you please tell me what if I go legal to recover my damages if the cost of fixing my car is more than the default driver's insurance policy could pay?

A: Assuming it's bad enough to worry about property damage, then you need to see a member of the Florida Justice Assn about your injury claim. If you have collision run it through yours if that's higher. Yours will collect from his.

I think the person you spoke with is wrong--at least in Pennsylvania your rates can't go up because of a claim unless you are at fault. Also, in this case, they get to recover what they pay out. Time to change companies?
