Huntington Station, NY asked in Traffic Tickets for New York

Q: My son received a ticket for expired inspection in my car. Does he have to attend the Pretrial conference?

Can I handle the ticket without him, or do I need to schedule a conference when he is home from college?

A: The charge of operating a vehicle with an expired inspection was issued to your son as the driver. However, as far as the DMV is concerned, you as the owner/registered owner, are the one with the legs responsibility to keep the inspection current. I suggest you call the Court and find out whether you can simply appear with proof that you've either taken the car off the road and turned in the plates, or that you've now got proof that the car has been inspected and passed. Your son should not have to show up.

A: The attorney who responded below is correct, best to call the court if that's an option (NYC is difficult to reach people at TVB, but you can go in person and ask before the pre-trial conference date). If it's not in the 5 boros, you can call the clerk of the court and they can even note that file for you that you spoke and the answer they gave. Have the ticket handy when you call, the clerk's appreciate people who are prepared for the call with them.
