Clayton, IL asked in Family Law for Illinois

Q: Can our caseworker make a hotline call on us for being pregnant and currently trying to get his daughter home?

So we are trying to get her back from dcfs, her mother lost custody of her while he was in prison. I have a child and have never been involved with dcfs before until now with getting her back I passed everything and needed no extra counseling or anything else. We are doing what we need to in order to get her back but we are pregnant could our case worker make a hotline call about the new baby?? And if so why? I haven't done anything wrong have no history of drug abuse or neglect and have a 3 year old who has been in MY custody since birth. And my husband was not the reason she is in dcfs right now her mother is due to drugs.

A: Unless the DCFS worker believes the unborn child is at risk (doing drugs, history of violenc etc.) she shouldn't be making a hotline call. The only concern would be living conditions--if there is enough space in the household for an extra child.

A: A caseworker can make a hotline call for any reason. Particularly if u have a child in care and another one is on the way. Be honest with them. Get a lawyer.
