Aurora, IL asked in Immigration Law for Illinois

Q: H1b I-797 valid until 2020, but 'admit until date' until 9/21/17. Is it safe to travel to Canada before 9/21/17?

My old H1b visa were to expire on 9/21/17, as a result the 'admit until date' on my passport and online (I-94 website) is 9/21/17 as well. I recently got my new H1b I-797 approved until 2020, but the 'admit until date' still states 9/21/17. Is it safe to visit Canada for a week and come back before 9/21/17? Or will I have to travel to my home country and get a new stamp on my passport?

Thank you

A: Someone who has a valid H-1B visa stamp in his or her passport, even based on previous H-1B employment, can use that visa stamp, with the new I-797 H-1B approval notice, to return to the United States any time up until the expiration date on the passport visa stamp (not the I-797 expiration date - that would require a new visa)..
