Q: I want to write a written motion, about having my child while My Divorce is ongoing. I don't know how to start it.
I would like to know how to form my written motion asking to have visitation to my daughter, while my Divorce is ongoing. My ex-wife, called the police on me stating that I was an estranged boyfriend and I kidnapped my own child. I stayed away from answering her messages because she isn't a trustworthy person. I need documentation stating that I can have my child for periods when I want to get her.
A: Motions can be complex and are fact sensitive. You should seriously consider consulting with an attorney if custody and visitation are at issue in your divorce case. There are not going to be any form documents for you to use. You will need to outline why the child should be with you and why that is in the child's best interest. You will also need to be prepared for a hearing to combat your wife's allegations through your presentation of evidence. Custody battles are complicated, and should not be taken lightly if you want to have time with your child.
