Kendall Park, NJ asked in Probate for Florida

Q: personal rep

My one brother passed away on 11/8/2016 and named my other brother as his personal representative in his will. He also named another person if he didn't want to do it or was unable to do it. He was taking care of the estate and then he passed on 11/17/16. My second brother didn't have a will. Since he passed 9 days later would this make my mother personal representative of his estate or would it go to the other person mentioned in the will?

A: From he facts you state the PR would be the next person named in the will after your brother.

I think that I have said this before to you but you need to hire a lawyer.

A: I am sorry for the loss of your two brothers.

The personal representative roll would go to the alternate personal representative named in the Will, unless they are unable or unwilling to handle the estate or if there was some reason they should not be named personal representative. Best of Luck! Jennifer
