Q: My mom went to Wal-mart and as she was leaving she slipped on oil in the Wal-mart parking lot. Can my mom sue Wal-mart?
My mom had just recently had hip surgery last month and when she went to the Springdale Wal-mart as she was leaving to the car she slipped on oil in the parking lot. She is currently at the hospital due to the injury. My brother says he took photos of the oil in the parking lot my mom slipped on and said that an employee at Wal-mart knew about the oil because they went around it while getting the carts outside. If a Wal-mart employee knows about the oil and nobody at Wal-mart cleans it up until after someone is injured by it, can my mom sue Wal-mart for pain and anything else?
A: Wal-Mart has a duty to provide a reasonable and safe environment for visitors. While Wal-Mart is not liable every time that an injury takes place, it could be held liable when it knew or should have known about a danger and failed to post a warning sign and / or clean it up in a timely manner. You should contact a local personal injury attorney to review the potential case. Most personal injury attorneys will provide a free consultation and (if the case is accepted) will handle the case on a contingency basis (no recovery - no fees). Good luck.
