Pacifica, CA asked in Uncategorized and Criminal Law for California

Q: i will be 18 in 2018 & my boyfriend will be 17.if we have been dating for 3 years is it still considered statutory rape

My family keeps saying that when I turn 18, if I have any sexual relations with my boyfriend who will only be 17, it can be considered statutory rape, but I've also heard that if you've been dating the person for a certain amount of time that it doesn't count as statutory rape. I am a female who will be 18 and my boyfriend will be 17. Does the amount of time that you've been dating the other person who is younger count/matter? Or is it still considered statutory rape

A: Sex with a minor is a crime. Consent from a minor is legally impossible. If both parties are minors, they may both be charged with a crime.
