Albany, NY asked in Adoption, Family Law and Child Custody for New York

Q: My sons father wants to terminate his parental rights.

I am single but this is something we both want. In NY do you really need somebody to step up and adopt? If so, can it be anybody? I am single but this is best for everybody. Could my mom adopt him? Or would it have to be an unrelated male? Also, is there any way around that so nobody has to adopt? And if he gives up his rights is there any way he could come back into our lives?

Thank you.

A: He can file a motion to terminate his rights. Then after the order of termination, an adoption petition can be filed. More details are necessary to provide a professional analysis of your issue.
