Los Angeles, CA asked in Car Accidents and Personal Injury for California

Q: A car pulled out of a parking lot, failing to yield. I hit the brakes on my motorcycle to avoid hitting the car, I fell.

I fell due to the bike skidding to a stop. The end result is a broken clavicle. The motorist did not stop due to him claiming "I didn't hit him".

Although he did fail to yield and cause an accident. I have since been out of work, attempting to collect disability, and medical coverage is being paid out of pocket due to my type of ppo.

Any advice or help would be greatly appreciated.

A: You have a claim against the driver for personal injuries. You should also report the other driver for no hit, hit and run. Contact PI attorney to discuss.

A: There does not need to be contact or property damage for there to be an injury claim against the at fault driver and the insurance company. It is very common for motorcycle accidents to occur without property damage to the vehicle. Consult with a personal injury attorney in your community as soon as you can. Good luck.

A: Contact a member of CAOC--they give free consults. As you sound like you have an uninsured motorist claim you need to file a police report to comport with most policies. Check and see if any businesses--including the parking lot the other person came out of--have any video.

A: I've handled a number of cases. I assume police responded--if not, under most uninsured motorist policies you need to report it to the police. Contact a member of CAOC for the county where the wreck happened. They give free consults. See if there's video of the are from a cam at one of the businesses.
