Q: Can a landlord demand $100 a day. When a tenent is waiting to close?
The tenent is waiting to close on a house probably on the August 7th, the last month of the lease is July 31. The landloard wants to charge $100 per day, the rent is less than $1,500 a month. Wouldnt the pro rated amount be $50 per day.
A: If the lease addresses overages, the lease governs. If the lease does not address this situation, there are a couple of different ways to go about it. Are you represented by an attorney in your closing? If so, I would recommend asking him or her to review the lease and advise as to your options. If you are not represented by an attorney, I highly suggest you hire one quickly, as it only costs a few hundred dollars and can save you a great deal of time, money, and stress in the long run.
