Saint Cloud, FL asked in Animal / Dog Law and Personal Injury for Florida

Q: My neighbor is trying to sue me for my dog running up to her. Does she have a case?

My dog was not on a leash and she went running up to my neighbor walking her dog, not aggressively, put playfully. She fell and then called the cops and ambulance. I was given a citaiton for not having my dog on the lease and the cops said they would come get my statement. They never came back and today i was served with papers from Morgan and Morgan. Does she have a case?

My dog as NEVER had any issues and my dog as previously run up to the same lady who thought it was funny before this incident

A: Florida has a strict liability law for dog bites and attacks. Furthermore, there typically is a dog leash law for each county and municipality. You should consult with an attorney or your insurance company for further advice. In Florida, the lack of a prior history of aggression, attacks, or bites typically does not serve as as defense for a dog owner.
