Austin, TX asked in Patents (Intellectual Property) for Texas

Q: Can I patent a new product to be specifically on a keychain so now one else can use the same idea?

I've got a new invention and want to see what kind of patents I can apply for

A: Under some circumstances, it may be possible. I've seen lots of things produced on a small scale and then they are attached to a ring to make a key chain tab. I've seen miniature flashlights, screwdrivers, tape measures, Rubic's Cube, etc.

But none of those 4 examples are likely patentable, because they are simply smaller versions of objects that work and behave just like their larger counterparts. So if you just take some object, make a smaller version of it, and stick it on a key chain, you won't get a patent. There must be something more to it.

You should also take a look at your business plan. Patents are a wonderful thing, but please consider that it will cost you $20K to $40K to get and keep this patent. How much more money can you make on selling your key chains in order to make getting a patent worth your while?
