Q: First time DUI innocent help me
I was charged with a DUI. No one seen me inside the car no injury accident. Now earlier that day I was assaulted. So I had already been to the hospital that day the doctor offered me pills. I told the nurse no did not take the pills. Later that day doctor called the police. The nurse brought me the pills I refused says I took pills. So I was taken to jail. In blood test my meds for panic, pot where found. The pills I refused where not. What happened to those pills? If I did not take them who did? My public defender wants me to take a deferred pay money. I do not have memory of the wreck I know that was not my car. The owner wrecked the car took off. Leaving me knock out. My public defender is telling me I will do a year in jail if I take this to trial. I have not one other charge ever not even a city charge nothing clean record. This guy said he has important cases to deal with. That they never take DUI cases to trial. He is going to try and get taken off my case.
A:
It sounds like your Public Defender is too lazy to take the case to trial. Insist on a replacement attorney, and (if you are going to possibly do jail time) have your day in court, to plead your case. Listen to the attorney you are represented by, since most good criminal attorneys do NOT have their clients testify. He os she will know best.
