Frederick, MD asked in Family Law for Maryland

Q: Now that I have been placed on disability should I request an increase in child support from my ex husband?

When we first divorced I worked full time as an RN, and the amount we agreed on was $400/mo for 1 child. This amount was never ordered through a court it was an amount we both agreed on. He's still currently at the same job, but has verbalize how tight his finances have become due to a new baby and a new mortgage. Unfortunately finances for myself are extremely tight just being on a fixed income! I feel awful demanding more money from him but wonder if it's legally my right to receive more?

A: Since you don't have an order setting out the father's child support obligation, you should file a complaint for child support with the court. The court will determine the parties' obligations based on the Maryland child support guidelines. Since the guidelines are based on both parents income, it is likely that the father's obligation may increase. You should contact a lawyer for assistance.
