A: Is the green card that you received through marriage a 2-year conditional green card and, if so, I assume that you are referring to a Petition to Remove Conditions case when you speak of applying for "a second one." One who is getting divorced can file the Petition to Remove Conditions without the U.S. Citizen Spouse's help and can receive an unconditional green card upon approval of the Petition to Remove Conditions, but one must demonstrate that despite the marriage ending in divorce, it was nonetheless a good faith marriage. You should schedule a consultation with a competent immigration attorney who can analyse the specific facts of your case. Some attorneys, like me, offer online (Skype) or telephone consultations for prospective clients who are unable to attend in person.
