Dallas, TX asked in Medical Malpractice and Health Care Law for Louisiana

Q: Has my minor childs Hippa Rights been breached or violated ?,

A woman that I know who's child does not get along with my children works at the pharmacy where my child's lice medication was called into. She is a Tech and assited in getting my child's medication ready for pickup. About an hour after picking up her prescription I received a text message from the woman's daughter stating that her mother wants to know if my children have lice because they now have lice. I feel that the woman called her daughter just to tell her that my child has a prescription for lice treatment just to make fun of my child. Her child didnt even know my child had an appt. They attend different school. So I would like to know if her hippa rights have been breached. Thanks.

A: Unlikely under the facts but even if they were it's problematic legally as there is no remedy for the person in the Privacy Act!
