Q: A friend of my wife's borrowed my wife's car (its in her name only) and caused a wreck. Can I be sued?
I live in Tennessee....A friend borrowed my car and caused a wreck. Can I be sued?
A:
First if you had insurance, you make copies of what you got served, you fax a copy to the adjuster who is handling your wife's case, you send hard copy certified return receipt. At the top of each page you right "insured: _______________" and your wife's name, you put the claim number next to or right under it stating "claim number...."
When your insurance company hires a lawyer for you discuss your getting off the summons, and possibly your wife. Assuming the friend wasn't a notorious drunk, I don't see that your wife has exposure. Second, your wife needs to find out if her friend has insurance. The insurance on the car is primary, but the friend's is secondary. Do all that, take a deep breath, and relax a bit.
