Q: Can I extend my H1b for 1 year after six years recapturing 2 and half month when I was abroad ?
I work in a University. My current H1B expires on Jan 15,2018. I have a EB2 NIW I 140 receipt date March 13, 2017. I spent about 2 and half months abroad during my 6 yr on H1B. Can I extend my H1B for one more eyar recapturing those 2 month? Thanks for your time and answer.
A: Any time spent outside of the US while in H-1B status can be recaptured in order to extend the initial six year H-1B period.
