Q: accident on record

Hi I got into an accident driving a cdl vehicle, no tickets were issued, will it be reported on my driving record? Thanks

A: Hello Asker,

Unfortunately, it is highly likely to be reported as an accident on your Illinois abstract as a Type action 14, 16, 19, or 80. These are classifications that there WAS an accident though not necessarily establishing fault or liability associated with them. My understanding is that this is a type action generated on your MVR not by a specific ticket but rather the Department of Transportation report sent in either by the Officer or the driver (not sure which. I have to check my record to see as my personal record can provide insight). My understanding is that nothing can be done to remove this from your record but you can provide future employers with a copy of the Department of Transportation reports about the accident as reported by the officer so that your company (insurance or employer) can take them into account and see it wasn't your fault.

Just keep in mind at least as far as Illinois drivers are concerned, failing to send in the accident report can result in a license suspension.
