Bloomington, IN asked in Family Law, Child Custody and Child Support for Indiana

Q: My son's on again off again father says he need my son's SSN to file for visitation? Am I in the wrong?

He is currently not medicated for schizophrenia that he was diagnosed with at Meadows (mental hospital)

I don't feel my son is safe around him. I have seen his behaviors personally and from his other son's mother as well as his own mother who we lives with. He says he needs my son's social to file for visitation and to pay me child support. I have not been served or asked by the court. He only plays daddy when it's convenient for him. My son is now 6 and refers to him by his first name rather than "dad" by his own choice. He tells me (insert name) yells at him and hurts his feelings when he sees him. I was even told by his other son's mother that my son witnessed him choking her. I believe her 100% bc the same happened to me when we were still together. I used to let my son stay with his grandma bc she told me his father would not be there Every other weekend. I have not let him stay for almost 3 months and now she is pushing his father to fight for visitation. We were never married

A: You are in a very serious situation here. Your number one priority should be protecting your child if there are instances of abuse or neglect. Report the father to Child Protective Services now. If the father does not have visitation rights now or any sort of court ordered custody, you are under no obligation to let your son see him.

As to the child's social security number, I am not aware of any requirement of the non-custodial parent to have the child's social security number to file for custody or to pay child support. Be aware that if you give the biological father your son's social security number he could use that to claim your son as a dependent on his tax return.

Furthermore, if you are interested in filing for child support, that is something that you can initiate on your end.
