Carthage, NC asked in Immigration Law for North Carolina

Q: Can I adjust my status if I just married a US citizen?

I was paroled to the USA back in 2014 when I went to Mexico. I just got married. No criminal record, and my marriage was done in good faith. If I can adjust my status, how long will this process take? Would I have to go back to Mexico? If my EAD from DACA expires, can I apply for another one with adjustment of status?

A: Since you entered on advance parole, you are not eligible to adjust your status to permanent resident through your U.S. citizen spouse. You will be able to apply for a new EAD through your adjustment application. The length of the process varies by your location, but on average you are looking at 6 to 8 months to complete the entire process.
