Q: My car was damage as a result of falling off lift in a shop we were inside bay i am shaken up help
A: The shop should take car of the damage to your car. I doubt you really have a psychological injury claim, but speak with a top notch PI counsel. Also report the accident to your carrier
A: You should be able to get the property damage covered by the shop and / or its insurance company. If you are seeking damages for emotional pain and suffering, that would be a bit of a challenge as the law in the State of New Jersey may now allow for recovery of these damages under these circumstances. There were no physical injuries suffered. You can ask an attorney licensed in New Jersey about the potential cause of action but there would likely be legal and practical challenges to such a case.
A: Contact a member of the New Jersey Assn for Justice--they give free consults, can advise you if psychological treament would be covered under the medpay provision of your insurance.
