Q: Will I be able to get alimony from my husband if i was legally married to someone else the first 7 years we lived

I have been married for 8 years but have been together a total of 14 yrs. I became disabled 5 years ago but I am still fighting for disability. I worked literally up until the day I became disabled. My husband has become increasingly mentally abusive during this time. He has been physically abusive in the past. He sometimes withholds basic needs such as disconnecting power and water because I don't deserve it. I need and want to leave but have no money and nowhere to go and am unable to work. I can't reach out for help because I have a child at home still. I don't know how I'm supposed to live. Can I get alimony even if I file for divorce? We own property and a half finished house but he refuses to finish building for the same reason as above. What will happen to that. There is no way I can live in the house unless it's complete I was married to my ex for the first 7 years we were together. We got married right after the 30 days but We owned property and had joint bank accounts for14

A: QUestions of alimony are fact driven and based on your need and his ability to pay. THere is no forumula for periodic alimony The property that the two of you own together or property that was acquired during the marriage or used during the marriage for the common benefit of the parties will be divided fairly between the two of you.
