Q: How long does it take to become an administrator of an estate ? In Clearwater FL

My brother died in april,, I hired a lawyer in may . He just filed papers in august. ... but still no papers .

I was told three weeks.. its 4 months ? Something does not seem right. also he left a house... do i need a lawyer to help sell house ?

A: In short. If your not satisfied with the representation. Hire a new lawyer. Really no way for me to second guess what is happening here or try to Monday morning quarter back him or her. Also there is no way to say what steps should be taken in selling the house other than most likely the house will need to pass through the probate.

A: If the estate is filed as a Formal Administration, the Personal Representative is typically appointed right away after the case is filed, unless someone objects. If the estate is filed as a Summary Administration, there is no Personal Representative and the assets are distributed by Court Order, which could be why you aren't getting the quick response. Without reviewing the case, I would have no way to advise you if things are on track in your case or not. As to the home, you would need to be appointed Personal Representative or receive the Court Order transferring title to you to sell the home. It is always a good idea to have an attorney assist you with your real estate transaction, especially if you want to sell "By Owner." If your intention is to sell, I wouldn't wait, start advertising the house for sale. Best of Luck! Jennifer
