Q: I hit a decorative rock that was left on the side of the road in a parking lot. Should I go after the parking lot mgm
There was a decorative large rock that was dragged out of a garden when an 18 wheeler tried to enter our parking lot. You can see the scrapes of the ground where the rock was dragged by the truck. The rock ended up on the road next to the curb. The rock was not visible as it was on a right hand turn and there are bushes in a garden in front of the turn. I could not see the rock when I made the turn and now the bottom of my car by the passenger door has a lot of damage. Is it worth going after the company that owns the parking lot/office buildings where this occurred? My insurance company has told me since the object was not moving it is my fault.
A: Your company is incorrect and trying to dodge your claim. However you could make a claim against the trucker and the company who left their rock there. Hopefully you took a picture of the rock in the road and police responded.
