Q: Are there certain lawyers who can take a case if I no longer reside in TX? I live in MO, Injury happened in McKinney.
I had a lawyer, but after a short time he had to drop my case. Since then I have had a hard time obtaining a lawyer. And up until recently my case was at a stand still due to denial after denial from the IC and a difficult adjuster. My injury happened on 12/8/2014. I was recently assigned a new adjuster who seems to be a lot better than the last. I had an appointment with a DD last year who didn't give me an IR but marked me to be permanently impaired. My new adjuster got me approved for another DD appointment but when I arrived Tuesday (around 3:01) he left and marked me as a no show; my apt. was at 3:00. I am now waiting to be contacted with his next available. It took forever to get the last one. Long story short: I am beyond frustrated, and am almost at the point of giving up because I know this process is not going to be easy. Diagnosis: bulging disc, radioucolpthy, loss of ROM of neck when turning right, and constant pain everyday, muscle spasms, and a lot of stress!!!!
A: There are good lawyers that can help with your case. Perhaps you can find one on the websites that answer questions for people. You simply need to have your DD appointment rescheduled. If you indeed have radiculopathy as proven by an EMG, and documented muscle spasms, or atrophy of at least 2 cm to one leg above your patella you should get at least 10% IR, resulting in 30 weeks of IIBs.
