Q: What can I do if the people I re-homed my dog to are refusing to pay for him? I signed a re-home contract for vet reason

I decided to re-home my amazing dog as my career took off and wasn't home much anymore and felt selfish keeping him as he deserves a home with lots of love and attention. I found such a home and after 5 weeks the new owners have yet to pay or follow through with our agreement. I did sign a re-home contract with them so they could take him to their vet, but am wondering how binding that is and if I'd stand a chance in small claims court?

A: Without knowing the terms of the contract, it is difficult to assess how strong your action is. However, as a general rule, if the purchasers have failed to fulfill their part of the contract, you certainly have a cause of action against them. I would recommend having an animal law attorney review your contract to get the best opinion on the strength of your case.

A: Did they sign the contract? What did it say? Typically this would be looked at as the sale of property and upon delivery of the property the sale is complete, so you may not be able to get them to pay your asking price. Also, depending on what the price was, it may not even be worth taking them to court. I have handled quite a few of these types of cases, and could give you a consult, but I do charge for my time because very few lawyers in the state have my level of experience in this field.
