Irving, TX asked in Family Law, Child Custody and Child Support for Oklahoma

Q: Can my son's father disappear and leave my son with family members/friends if he's the custodial parent?

My son's father is the custodial parent based out of Tulsa, OK and I, the mother, live in Dallas, TX and we have a final order in place that allows me to see my son twice a month. However, my son's father has been going through a lot of personal things recently dealing with addiction, etc (I have a copy of a citation where he got pulled over recently and drug paraphernalia was found)... I didn't know anything like this was going on until after our final order was signed. Now my son's father has moved to Texas and left my son in the care of his parents (my son's grandparents). I have my son right now, because he's on "Fall Break" at his school and my son's dad is no where to be found. My son's dad and his family won't give me his address or any other contact information (which is required per our current custody agreement). Now that my son is in my physical care, is there anything I can do? I read that a situation like this can be considered "abandonment" by the custodial parent?

A: You should schedule a consultation with an attorney to see if you might have a case for a modification of your current order.
