Q: Does a customer have the right to keep your rental equiptment without paying for it? If not, how do you get it back?

Im a small business owner who recently have a client who refuses to pay for the services rendered. My business is located in Georgia and the client is in Tennessee, they refuse to pay the invoices and insist on their own prices totally going against our policies and procedures. We have sent numerous invoices and scheduled two(2) pick up and drop offs which they refused and call the police, to only be told to handle in civil court. They have our rental system while we have theirs in our shop for diagnosis and repair. This is a small medical practice in Morrison, McMinnville, Tennessee. At this point they are basically refusing to pay any late fees and holding our property without payment and only wants to agree to their terms we were sought out for service not the other vway around.

A: It sounds like a lawsuit which more likely will have to be decided by a judge. If they signed agreements, you may prefer court as opposed to trying to settle with them. You should consult an experience litigation lawyer. They may be subject to being sued in your State. Ultimately, you will have to decide whether the time and expense of the lawsuit is worth what you may recover- adjust your business practices to avoid future similar situations.
