Q: Can my landlord charge me for rent money if they gave me a 60 day notice and we moved out before the 60 days are up?

A: Yes, if you did not give them at least 30 days written notice of when you were vacating. Their 60 day notice was NOT a notice for you to move out anytime up to the 60 days; it was a notice to move out or have your tenancy terminated on day 60. If you wanted to vacate sooner than that you needed to either serve the landlord with a 30 day notice of when you were leaving or negotiate ahead of time with the landlord to have them agree to let you move out on day 45 or whenever, without providing the 30 days written notice. If you did neither, the landlord can charge you rent either through day 60 or for 30 days after you restore possession to the landlord, whichever comes first.
