Q: In the state of nj do u need a warrant to search a vehicle or consent from the owner even if they claim they smell weed

A: No warrant needed under State v. Whitt. There are other avenues that a trained criminal defense lawyer can use to avoid a conviction.

A: The smell of weed is enough to search your car or person. Better defenses exist for a defense of a MJ case such as was the stop legal at all, lab reports, evidence receipts, etc, etc, thus get yourself a good lawyer if you want to have a chance at winning.
