Portland, OR asked in Landlord - Tenant for Oregon

Q: We recently moved into our unit in a duplex in Portland OR on a month to month basis starting June of this year.

Our landlord just told us that the back unit with the yard had just come available (which is what we wanted). It will be available Dec 1. Our current rent at the front unit is 1395. We pay all utilities but garbage. At time of signing this lease, he said the back unit wasn’t much more, which is why we agreed on the front unit and waiting for the back unit to become available. When we got the call, he said the rent is going to be 1615 plus uitlities! The only difference is a small yard and a carport. Same size unit and layout. Can he really charge us almost 250 more per month? Also keep in mind they are only charging the current tenants of the back unit 1400. How can I go about our landlord being fair and renting it to us for the same or at least close amount as the other tenants? We want to stay for a while and are good tenants. We made some updates to the front unit (painted a better neutral color).

A: You can certainly try to persuade the landlord but in the end, he is free to set the rent at any price he wishes and you either pay it or don't move into it. Ironically, he may have upped the rent some precisely because he thought you really wanted it and thus would pay more to get it. Good luck.
