Denver, CO asked in Family Law for Colorado

Q: How can I obtain updated residency for non custodial parent who won't share new address?

My children's father lives in CA & we live in Colorado. He is the non custodial parent, and I have full custody. He recently moved, but listed his WORK address on the driver's license and refuses to tell me where he's living. He wants to fly the children, under 7 years old, to stay with him for 4 days, but won't tell me where. I don't care where he is living, but I feel responsible for the children's well being, and I need to know where they will be staying.

Are there laws that require knowing parents' physical addresses that I can use to acquire his address? He also stopped paying child support with this move. I'm really concerned about where my young children will be, though.

A: You can insist on knowing where he lives if the children are visiting w/ him. You can request a court order for disclosure. You should retain an attorney since it appears you and he are not able to work together.

A: If your court orders do not contain a provision regarding keeping each other informed of home address you will need to file a motion with the court, explaining the situation, and asking the court to order that he provide the home address, including before the parenting time, and keep you informed of any changes to the address. You also have options tied into the back child support, which is a separate issue and has nothing to do with the parenting time, unless he is asking that you share in the cost of the plane tickets. There is no specific law or rule saying he has to keep you informed of his address. You should consider consulting with a family law attorney.
