Dear Long Beach:
It sounds like your matter is too far along, and too complicated for a appropriate response in this forum. I suggest that you speak with an attorney who can give you a more detailed answer to your question (a bit more on that later.)
If the judge makes an incorrect ruling, you can always ask for reconsideration. Or you can file an appeal, but you do not want it to get that far. Particularly as appeals are quite difficult to win, especially so if the appeal turns on the facts as opposed to the law of the case.
It also sounds like you may misunderstand how the law devolves property upon death, or may have missed an important filing deadline or made some other procedural mistake. Not that this cannot be corrected, I just cannot tell exactly where you are in the process or what you accomplished so far.
I would speak with an attorney right away, and the sooner the better. If you do not know where to find an attorney, you should try your local county bar association. County bar associations provide legal referral services that, for a nominal or no fee, get you with a consultation with an experienced attorney.
Good luck.
