Colorado Springs, CO asked in Criminal Law and Animal / Dog Law for Colorado

Q: What do you do when reports have been made to Animal Control that are completely false?

An anonymous neighbor reported that my dog is aggressive and "chased" someone down the street. First, IF my dog was to get out, he is not the type to come back. He would be lost until found by someone. Also, my dog stays inside the home until i get off work and is only outside for a short time of the day. When he is walked, it is on the leash. The Animal Control Officer that came by actually stated that my dog was very friendly and did not see any issues. The next day, my tree in the front had a limb that was hanging and it looked like someone kicked my landscaping (rocks and mulch) all over my yard. I believe someone is targeting me because of my dog? Is it smart to install some cameras? I know for a fact these complaints regarding my dog are false!

A: Do not leave your dog outside unattended and definitely put up surveillance cameras to watch your yard. They can't charge you with anything related to aggressive dog or drug dog at large without a witness who is willing to go on record.

A: Did the animal control officer issue a citation? If so, it would be in your best interest to not put details online that could be used against you in criminal court because a citation for a violation of the leash law or aggressive dog law is a criminal matter. If you were issued citations, it would be in your best interest to speak to an animal/criminal defense attorney to go over your defenses.
